RESUMO

A Organização das Nações Unidas é , atualment e, a ent idade de mai o representatividade mundial a promover os Direitos Humanos e as liberdades fundamentais. Em dois momentos principais, em 1982 e 2002, dedicou-se especificamente à temática do envelhecimento e, do debate entre seus membros, produziu documentos chamados Planos de Ação, que consistem em verdadeiras bases fundantes da nova cultura gerontológica. É deles que se ocupa este estudo, analisando as diretrizes de suas recomendações e, principalmente, o preceituado em relação a aposentadoria, trabalho, educação,suporte familiar, saúde e grupos minoritários, além de brevemente considerar os diferentes enfoques atribuídos naquelas duas oportunidades (Viena, 1982; Madri, 2002) e a natureza jurídica dos Planos, defendendo seu poder de vincular o Estado a cumpri-lo, em oposição ao argumento de que seja apenas “soft law”, não impondo nenhuma obrigação, portanto.

ABSTRACT

The United Nations is, currently, the most important world-wide entity to promote Human Rights and freedoms. At two moments, 1982 and 2002, UN was devoted specifically to the ageing issue and, from the debate between its members, produced documents called Plan of Action which are the basis of a new gerontological culture. This study analyses the guidelines of its recommendations and, particularly, what was said in relation to retirement, work, education, familiar support, health and minority roups. This article briefly considers the different approaches taken by the Conference held in Vienna (1982) and the other held in Madrid (2002). It investigates the legal nature of the Plans and defends their binding power contrasted to the argument that the Plans are just “soft law”, not imposing any obligations, therefore.
