Resumo

Este artigo pretende analisar a moradia do idoso, começando pela conceituação do termo “moradia” em diversas áreas, inclusive sob o ponto de vista legal. A lei agrega o adjetivo “digna” ao termo “moradia”. Procurou-se, então, verificar se existe dignidade nas diversas alternativas de moradia para o idoso, tais como morar sozinho, com a família, numa Instituição de Longa Permanência para Idosos ou numa república de idosos. Este artigo oferece algumas noções sobre o contexto social dessas alternativas de moradia, as peculiaridades que cada uma delas apresenta, as suas vantagens e desvantagens para o idoso, buscando com isso identificar se a previsão legal de “moradia digna” está sendo alcançada, de fato. Posteriormente é feito um alerta quanto ao papel do Estado e da sociedade para que o direito de moradia tenha eficácia plena, tanto no plano vertical quanto horizontal, ou seja, na relação do idoso com o Estado e com a sociedade. Assim, políticas públicas habitacionais, bem como o respeito à escolha da moradia, são questões que devem ser enfrentadas com muita seriedade. O artigo finaliza com uma proposta de ampliação do conceito de dignidade quanto à moradia dos idosos, instigando o leitor a repensar esse conceito, de modo a tornar este direito social fundamental plenamente eficaz.

Abstract

This article analyzes the elderly housing, beginning with the conceptualization of theterm “housing” in several areas, including from the legal point of view. The law adds the adjective “dignified” to the term “housing”. The objective of this paper is then to find out if there is dignity in various housing alternatives for old people, such as living alone, with family,in a long-stay institution for the elderly or a fraternity for elderlies. This study offers some information on the social context of these housing alternatives, the peculiarities that each presents, their advantages and disadvantages for the elderly, seeking thereby to identify if the legal provision of “adequate housing” is being achieved indeed. After that, this paper presents an alert about the roles of the state and the society in order to make sure that the housing law has full effect, both vertically and horizontally, in other words the elderly’s relationship with the state and society. Thus, housing policies, as well as respect for housing choice are issues that must be addressed very seriously. The article is finished with a proposal to expand the concept of dignity of housing for the elderly urging the reader to rethink this concept in order to make this fundamental social right fully effective.
